CCTV Privacy Notice
This notice explains how Spitfire Homes uses CCTV and, where installed, automatic number plate recognition (ANPR) at its offices and building sites, and how we look after the images and information those systems record.
Who we are
This notice is issued by Spitfire Bespoke Homes Limited, trading as Spitfire Homes (“Spitfire”, “we”, “us”), registered in England and Wales under company number 04395875, with its registered office at The Gate, International Drive, Solihull, B90 4WA. Spitfire is the data controller for the personal data described in this notice.
We are not required to appoint a Data Protection Officer. Please send any questions about this notice to the Data Protection Lead, Spitfire Homes, at the address above.
What we record
- CCTV images: footage of people, vehicles and property, with the date, time and camera location.
- ANPR and vehicle data: registration numbers, vehicle images, make, model and colour where visible, entry and exit times, and whether a vehicle is on an authorised access or parking list.
- Incident records: incident references, investigation notes, witness details, police or insurance references, and logs of who has viewed or exported footage.
Footage may incidentally show information such as health, disability or religious dress. We do not use CCTV to learn about these things, and we do not use facial recognition, biometric identification or automated profiling.
Why we use CCTV
- To keep our staff, contractors, visitors, customers and the public safe.
- To protect our offices, building sites, materials, plant and vehicles.
- To prevent and detect crime, trespass, theft and vandalism.
- To manage site access and parking.
- To investigate accidents, incidents and disputes, and to deal with insurance claims, legal claims and regulators.
Our lawful basis
We rely on our legitimate interests in keeping people and property safe and secure, managing access to our premises and sites, and investigating incidents. We only rely on legitimate interests after checking that our use of CCTV is necessary and proportionate and that it does not override your rights. Where the law requires us to keep or disclose footage, for example under a court order or our health and safety duties, we rely on legal obligation.
Who we share it with
Access to footage is limited to staff and contractors who need it, all of whom are bound by confidentiality. Specialist security companies run some of our CCTV and ANPR systems on our behalf; they may only use the data on our instructions. We may disclose footage to the police, insurers, legal advisers or courts where this is necessary or required by law.
How long we keep it
Footage is normally overwritten automatically after a short period. Where footage is needed to investigate an incident or claim, we keep it until the matter is resolved and then delete it securely.
Transfers outside the UK
We do not knowingly transfer personal data outside the UK. If this changes, we will put appropriate safeguards in place as UK data protection law requires.
Your rights
You have the right to ask for a copy of footage of you, and to ask us to correct, erase or restrict our use of your data, or object to it. Some rights are limited, for example where footage is needed for a criminal investigation. To make a request, please write to the Data Protection Lead at the address above, giving the date, approximate time and location so we can find the footage.
Complaints
We would like the chance to put things right, so please contact us first. You can also complain to the Information Commissioner’s Office (ICO), Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF; telephone 0303 123 1113; ico.org.uk/make-a-complaint.
